Physician sues hospital, DHHR, others for wrongful termination

CHARLESTON -- A physician is suing the West Virgina Department of Health and Human Resources, Welch Emergency Hospital, Daniel & Yeager Inc. and two individuals after he claims he was wrongfully terminated from his employment.

Dr. Majester Abdul-Jalil, a general practice physician, had medical staff privileges in pediatrics and internal medicine at Welch Emergency Hospital, according to a complaint filed Jan. 27 in Kanawha Circuit Court.

Abdul-Jalil claims during his eight years of practice he was never sued for medical malpractice, disciplined for unprofessional behavior or had his hospital privileges revoked.

Abdul-Jalil's employment contract with Daniel & Yeager called for him to serve on a month-to-month basis, according to the suit.

Between August 2006 and January 2008, Welch Community Hospital recruited Abdul-Jalil to enter into a more permanent agreement to provide services at the hospital as an independent contract physician, according to the suit. Abdul-Jalil claims they never reached an agreement.

Abdul-Jalil claims on Dec. 27, 2007, he was involved in a verbal dispute with another physician over the proper course of treatment for a patient. A registered nurse, Peggy Miller, informed Abdul-Jalil that he was to leave the premise of the hospital.

The other physician was not asked to leave the hospital, according to the suit. Abdul-Jalil claims he met privately with Walter Garret, CEO of the hospital, who told him he was not to return to the hospital until he was notified.

Abdul-Jalil claims no one has since contacted him and his privileges were later revoked from the hospital.

Abdul-Jalil is seeking compensatory and punitive damages. He is being represented by Trent A. Redman and Michael D. Payne.

The case has been assigned to Circuit Judge Carrie Webster.
