CHARLESTON -- A couple is suing Clayton Homes and three of its employees for age discrimination.
Russell and Carolyn Murdock were employed by Clayton Homes.
On Dec. 14, 2007, the Murdocks claim Marvin Stanley, Chuck Morgan and Chris Cowes began to subject Mr. Murdock to age discrimination, according to a complaint filed Jan. 29 in Kanawha Circuit Court.
Mr. Murdock claims the defendants specifically advised him they were aware of a 35-year-old person they had in mind to replace him once he was no longer employed.
On Jan. 31, 2008, Mr. Murdock claims he was wrongfully terminated from him employment at Clayton Homes.
Mrs. Murdock claims she witnessed the discriminatory practices against her husband, but continued to work at Clayton Homes until July 7, when she was forced to resign because the defendants harassed her.
The Murdocks are seeking compensatory and punitive damages. They are being represented by Michael A. Olivio.
The case has been assigned by Circuit Judge Carrie Webster.
