Contractor sues Epperly Realty for breach of contract

CHARLESTON -- A Cross Lanes building contractor is suing Epperly Realty LLC because he claims they owe him more than $10,000.

Jack Cochran and Epperly Realty entered into a building contract to repair Epperly Realty's roof of its building, according to a complaint filed Feb. 4 in Kanawha Circuit Court.

Cochran claims upon completion of his contractual obligations, Epperly Realty was to pay him the total amount of $21,027.30 for services and work performed.

A partial payment was made upon completion and the rest of the money was to be paid within 30 days, according to the suit.

Cochran claims the defendant has breached its contract, which has resulted in him sustaining economic damage in the amount of $11,027.30.

Cochran is seeking compensatory damages in the amount of $11,027.30. He is being represented by J. Robert Leslie of Tyree, Embree & Leslie.

The case has been assigned to Circuit Judge Louis Bloom.
