River Place sues man for defaulting on lease agreement

HUNTINGTON -- A Barboursville company is suing a Proctorville, Ohio, man for failure to pay rent.

On May 1, 2008, River Place entered into a lease agreement with Stephen A. Mondlak, who was doing business as Monty's Pizza, for real estate located on U.S. 60 East in Barboursville, according to a complaint filed Feb. 9 in Cabell Circuit Court.

River Place claims Mondlak was to pay $1,415 each month for five years from May 1, 2008, until April 30, 2013.

Mondlak has not paid rent since November 2009, has ceased its business operations at the leased premises and has abandoned the premises, according to the suit.

River Place claims Mondlak is in default under the lease agreement for failure to pay rent. The company claims Mondlak is required to pay rent for all months from November 2009 until April 2013, which totals $59,430.

River Place is seeking damages in the amount of $59,430 with interest at the legal rate from the date of judgment until paid in full. The company is being represented by Audy M. Perry Jr. and Chad S. Fisher of Huddleston Bolen.

The case has been assigned to Circuit Judge David M. Pancake.
