River Place sues KDKM for failure to pay rent

HUNTINGTON -- River Place is suing KDKM for failure to pay rent on a leased building.

On July 11, 2003, River Place's predecessors entered into a lease agreement with Whitaker Corporation, who was obligated to pay $2,746.33 each month for five years from Dec. 1, 2003, until Nov. 30, 2008, according to a complaint filed Feb. 9 in Cabell Circuit Court.

River Place claims on Dec. 1, 2003, they amended the July 11, 2003, lease agreement so that it would commence Jan. 1, 2004 and end Dec. 31, 2008.

On Dec. 30, 2006, Whitaker Corporation and KDKM entered into an assignment and assumption of lease and consent of landlord in which Whitaker Corporation conveyed its entire right, title and interest in the lease to KDKM, according to the suit.

River Place claims KDKM was responsible for the satisfaction of all obligations owed to them and did not pay rent for the months of November and December 2008 in the amount of $5,492.66.

River Place is seeking damages in the amount of $5,492.66 with interest at the legal rate from the date of judgment until paid in full. The company is being represented by Audy M. Perry Jr. and Chad S. Fisher of Huddleston Bolen.

The case has been assigned to Circuit Judge F. Jane Hustead.
