CHARLESTON -- Eight couples, one man and two widows name 170 defendants in 11 asbestos-related cases.
The plaintiffs claim the 170 companies exposed them the asbestos dust during their employment and caused their lung injuries, according to complaints filed Feb. 10 in Kanawha Circuit Court.
Hugo T. Alexander and his wife, Leigh Alexander, of Mingo County, claim Mr. Alexander was diagnosed with asbestosis and lung cancer; Charles G. Artmeier, of Martinsville, was diagnosed with asbestosis and lung cancer; Ruben B. Birkhimer and Tammi L. Birkhimer, of Fruitland Park, Fla., claim Mr. Birkhimer was diagnosed with asbestosis and laryngeal cancer; Ester R. Coen, of Pine Grove, claims her late husband James E. Coen, was diagnosed with asbestosis and lung cancer; Kimberly Goodwin, of Kennedy Township, Pa., claims her late husband was diagnosed with asbestosis and lung cancer; Terry J. Holland and Kay L. Holland, of Edgewater, Fla., claim Mr. Holland was diagnosed with asbestosis; Charles E. Neitzelt and Lois L. Neitzelt, of Wheeling, claim Mr. Neitzelt was diagnosed with asbestosis and lung cancer; Wilbur L. Richardson and Nancy J. Richardson, of Bellaire, Ohio, claim Mr. Richardson was diagnosed with asbestosis and lung cancer; Lester I. Walker and Beverly A. Walker, of Girard, Ohio, claim Mr. Walker was diagnosed with asbestosis; and John E. Weaver and Ethel M. Weaver, of Follansbee, claim Mr. Weaver was diagnosed with asbestosis and mesothelioma.
The plaintiffs claim they have suffered damages for medical treatment, drugs and other unknown remedial medical measures; great pain of the body and mind; embarrassment and inconvenience; loss of earning capacity; loss of enjoyment of life; and shortening of life expectancy.
The plaintiffs are seeking a jury trial to resolve all issues regarding their asbestos-related cases. They are all being represented by David P. Chervenick, Bruce E. Mattock, Lee W. Davis and Scott S. Segal
The cases have been assigned to a visiting judge.
