Couple sues C.R. Bard, Covidien for medical device defects

HUNTINGTON -- A couple is suing C.R. Bard Inc. and Covidien Inc. after they claim the companies' products caused injury.

Tammy Clark was implanted with the products during surgery performed by Dr. Mitchell E. Nutt at St. Mary's Medical Center to treat pelvic organ prolapse, according to a complaint filed March 3 in Cabell Circuit Court.

As a result of having the products implanted in her, Clark has experienced significant mental and physical pain and suffering; has sustained permanent injury; permanent and substantial physical deformity; and loss of a bodily organ system. She has undergone corrective surgery and has endured impaired physical relations with her husband, Jimmy Dale Clark, according to the suit.

The Clarks claim the defendants had a duty to individuals to use reasonable care in designing, manufacturing, marketing, labeling, packaging and selling products and were negligent in failing to do so.

The Clarks are seeking compensatory and punitive damages. They are being represented by Paul T. Farrell Jr., Lawrence J. Tweel and J. Robert Rogers

The case has been assigned to Circuit Judge F. Jane Hustead.
