Couple sues TJX Companies for injuries

CHARLESTON -- A woman and her husband are suing TJX Companies, Inc., for injuries she sustained at the company's Charleston location.

On March 8, 2008, Duty E. Perdue was shopping at the TJ Maxx store when an overloaded metal rack of merchandise fell and struck her, according to a complaint filed Feb. 26 in Kanawha Circuit Court.

Perdue claims the defendant's employees recklessly, willfully, wantonly and negligently overloaded the metal rack with clothing and other merchandise.

As a result of the injury, Perdue sustained injuries to her head, neck, shoulders and upper back, according to the suit.

Perdue claims she has sustained medical expenses and her husband, Kenneth M. Perdue, claims he has sustained great and irreparable loss in that he has been deprived of the society, companionship, consortium and services of his wife.

The Perdues are seeking compensatory damages in an amount less than $75,000. They are being represented by Thomas P. Maroney.

The case has been assigned to Circuit Judge Carrie Webster.
