Point Pleasant woman sues 58 companies in asbestos case

CHARLESTON -- A Point Pleasant woman is suing 58 companies in an asbestos-related case.

Ruth Daily is the Administratrix of the Estate of Owens Lee McDade, who was diagnosed with lung cancer in November 2006 and died March 22, 2008, according to a complaint filed March 18 in Kanawha Circuit Court.

Daily claims McDade was exposed to asbestos products of the defendants while working at various job sites in West Virginia and Ohio over many years.

The defendants are being sued for negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.

Daily is seeking a jury trial to resolve all issues in the asbestos-related case. She is being represented by Victoria Antion and Cindy J. Kiblinger.

The case has been assigned to a visiting judge.
