CHARLESTON -- A woman is suing Nissan North America Inc. after he claims the company failed to repair defects in his vehicle.
On Aug. 2, 2007, Shanda D. Dailey entered into a contract with the defendant for the purchase of a new 2007 Nissan Quest, according to a complaint filed March 18 in Kanawha Circuit Court.
Dailey claims he later discovered defects in the vehicle and returned it to the dealership on at least three occasions for repair, but the defendant failed to repair the defects.
As a result of the defective condition of the vehicle, Dailey has incurred substantial damages arising from replacement costs, lost value, expenses incurred in connection with attempted repairs, loss of use and annoyance and inconvenience, according to the suit.
Dailey is seeking for acceptance of the vehicle to be revoked and her money to be returned to her. She is being represented by Mary Downey.
The case has been assigned to Circuit Judge Carrie Webster.
