Woman sues Kroger for injuries

CHARLESTON -- A Charleston woman is suing the Kroger Company after she fell and was injured in the store.

On Dec. 24, 2009, Rochelle Himon was shopping at the Charleston Kroger store when she slipped and fell on a foreign substance or wet floor, according to a complaint filed March 19 in Kanawha Circuit Court.

Himon claims the defendant knew or should have known about the dangerous condition and was negligent in failing to fix it.

As a result of the fall, Himon sustained injuries to her body and mind, as well as incurring great pain and suffering; medical expenses; loss of enjoyment of life; lost wages; loss of income; and a diminution in her earning capacity.

Himon is seeking compensatory damages. She is being represented by Bruce L. Freeman.

The case has been assigned to Circuit Judge Jennifer Bailey.
