Ultimate Health sues former physician for violation of employment agreement

HUNTINGTON -- Ultimate Health Services is suing a former employee for failing to reimburse more than $14,000 to them for breach of contract.

On April 2, 2007, Ultimate Health Services and Dr. Alejandro Lorenzana entered into a Physician Emplyment Agreement whereby Lorenzan would provide care services to the plaintiff's patients, according to a complaint filed March 30 in Cabell Circuit Court.

Ultimate Health Services claims in the employment agreement it agreed to pay for Lorenzana's moving expenses from Amarillo, Texas, to Huntington, which cost approximately $14,145.18.

Section 5 of the employment agreement states that of the physician would decided to leave within 24 months, the physician would reimburse Ultimate Health Services for the full amount of the moving expenses paid, according to the suit.

Ultimate Health Services claims in September 2008, Lorenzana announced his resignation, which was within 24 months of his commencement date of employment with the company.

Lorenzana is required to repay Ultimate Health Services the moving expenses of $14,145.18 and has failed to reimburse the company, according to the suit.

Ultimate Health Services is seeking monetary damages in the amount of $14,145.18. The company is being represented by Thomas H. Gilpin and Scott K. Sheets.

The case has been assigned to Circuit Judge F. Jane Hustead.
