WINFIELD -- Powerball lottery winner Jack Whittaker is suing an individual he claims owes him more than $50,000.
On Feb. 11, 2004, Jackie Hatcher executed a promissory note made payable to Whittaker in the amount of $50,000, with interest at a rate of 6 percent, according to a complaint filed April 12 in Putnam Circuit Court.
Hatcher received the $50,000 by a wire transfer from Whittaker's checking account, according to the suit.
Whittaker claims the repayment period was not to exceed five years, with the first interest payment due Jan. 1, 2005, but Hatcher has failed to make any payments on the promissory note.
As of Jan. 1, Hatcher owes Whittaker the full principal amount of $50,000, plus interest in the amount of $18,102.79, according to the suit.
Whittaker's bank statement, part of which is attached to the complaint, includes purchases from QVC, Petals & Silks, Elder-Beerman, Will Jewelry & Loan and various pharmacies and gas stations, according to the suit.
Whittaker is seeking damages in the amount of $68,102.79, plus pre- and post-judgment interest. He is being represented by Amy A. Acord.
