CHARLESTON -- A man is suing Chevron Corporation after he claims it made fraudulent and negligent misrepresentations in regards to underground storage tanks located on property in Charleston he once owned.
On Sept. 26, 2008, Nu Rentals, LLC, filed a complaint against Gary Lee Chandler alleging he was the owner and operator of underground storage tanks located on property sold by Chandler to Nu Rentals, according to a complaint filed March 30 in Kanawha Circuit Court.
On Feb. 6, 2009, Chandler filed his original answer to Nu Rentals' complaint, denying he was the owner and operator of the underground storage tanks, and on Nov. 5, he filed his motion for summary judgment requesting the court find he was not the owner or operator of the underground storage tanks because he never operated them during his ownership of the property.
Chandler claims he explained he purchased the property from Texaco, Inc., who is now part of Chevron Corporation, for the purpose of constructing and operating a car wash.
Chevron acted in bad faith with gross fraud, malice and oppression when it intentionally, willfully, wantonly, recklessly and negligently made material misrepresentation to the West Virginia Department of Environmental Protection that Chandler owned and operated the tanks, according to the suit.
Chandler is seeking compensatory and punitive damages. He is being represented by Richard L. Lewis and Marc C. Bryson.
The case has been assigned to Circuit Judge Tod J. Kaufman.
