James H. and Ruth E. Midkiff vs. Cequel III Communications I, LLC, d/b/a Suddenlink; John Does I and II

* The Alum Creek couple wants compensated for the fire destruction of their home and contents in December 2009 they say was caused by the negligence of the TV cable company and two workers. Midkiffs say they had requested removal of their cable system before an electrical power line fell and contacted the cable wiring with high voltage, causing fire. They pray for jury award of compensatory and punitive damages, plus litigation costs.

* Judge Jay M. Hoke set June 4 for a hearing on a petition to partition real estate occupied by deceased couple Elmer and Myrtle Dingess. Robert Dingess, as a tenant in common with the four defendants, believes the best interest of the co-owners will be promoted by sale of the inherited property.

Erie Insurance Co. vs. Sandra Adkins

* Erie says its insured 2004 model pick-up truck was negligently struck on U.S. Route 119 in Charleston in November 2008 by a vehicle driven by Adkins. Complaint says the Griffithsville woman ran a red light at the Emerald Road intersection and collided with the turning pick-up truck. Erie wants judgment for the $16,586 value of the insured vehicle, compensatory damages, pre- and post-judgment interest and litigation expenses.

Brittany Egnor, an infant, who sues by her next friend, Tressa Egnor, and Tressa Egnor in her own right vs. James E. Sanders, Deloris Sanders and Jarred Adkins

* Complaint details July 2008 accident near Hamlin where the vehicle driven by James Sanders turned over off Mud River Road. Brittany Egnor was a passenger. Deloris Sanders is implicated as owner of the pick-up truck driven by James Sanders. Adkins allegedly was drag racing Sanders when Sanders attempted to pass and lost control. The Egnor girl "was thrown and knocked violently against the interior of the..." Sanders vehicle, according to the complaint, which claims excessive speed and alcohol were involved. The minor Egnor demands judgment, both jointly and severally, against defendants for a sum to be determined by a jury, plus pre- and post-judgment interest, litigation costs and punitive damages. Tressa Egnor seeks jury judgment in a "second count" that repeats her daughter's demands.
