CHARLESTON -- A Glasgow woman is suing RJ Recycling and Poor Charlies & Company after she claims they have caused her property damage.
RJ Recycling operates a salvage yard in Riverside on property owned by Poor Charlie & Company, according to a complaint filed April 5 in Kanawha Circuit Court.
Wilma Garretson claims RJ Recycling uses large shredding machines capable of shredding vehicles and large appliances and processes the material by reducing its bulk and separating and sorting it.
As a result, various substances are released as waste, exhaust, fallout and/or other by-products at the facility, according to the suit.
Garretson claims the piles of materials are exposed to the environment and not protected from air currents and water erosion. She claims her property continues to be contaminated with pollution from the recycling facility and is a nuisance to the surrounding community.
Garretson is seeking compensatory and punitive damages. She is being represented by John H. Skaggs and G. Patrick Jacobs.
The case has been assigned to Circuit Judge James C. Stucky.
