Couple sues C&O Motors, GM over truck problems

CHARLESTON -- A couple is suing C&O Motors and General Motors for breach of express and implied warranty after they claim they failed to fix their vehicle.

On Aug. 3, 2009, Rodney and Patricia Jones purchased a truck from the defendants, according to a complaint filed April 14 in Kanawha Circuit Court.

The Joneses claim they have experienced a recurring problem with the vehicle since its purchase and the defendants have failed to correct the problem.

The defendants wrongfully refuse to recognize that a problem exists and refuse to make certain that the problem does not arise out of a design or manufacturing defect, according to the suit.

The Joneses are seeking compensatory and punitive damages. They are being represented by Dana F. Eddy.

The case has been assigned to Circuit Judge Tod J. Kaufman.
