Kanawha couple sues Starcraft RV, Mountain State RV for defective vehicle

CHARLESTON--A Kanawha County couple is suing Starcraft RV and Mountain State RV after they claim the companies violated the West Virginia Consumer Credit and Protection Act.

On Feb. 23, 2008, Gary and Ellen Duncan purchased a 2008 Star Stream SS3416 from the defendants, according to a complaint filed April 12 in Kanawha Circuit Court.

The Duncans claims the defendants assured them that the vehicle was new and in excellent condition and had no history of prior problems or damages.

The vehicle was not in new or excellent condition and the Duncans experienced numerous problems that the defendants failed to correct, according to the suit.

The defendants failed or omitted to inform the Duncans that the vehicle was defective, according to the suit.

The Duncans are seeking compensatory and punitive damages and for the contract with the defendants to be canceled. They are being represented by Michael L. Glasser.

The case has been assigned to Circuit Judge Carrie Webster.
