U.S. FoodService sues restaurant, owner for failure to pay

WINFIELD -- U.S. FoodService Inc. is suing a restaurant and its owner for breach of contract for failure to pay for services.

On June 17, 2009, U.S. FoodService entered into a contract to provide Gibson's Family Restaurant and Matt Gibson with various supplies, materials and services, according to a complaint filed April 19 in Putnam Circuit Court.

The company claims the defendants have failed to comply with the terms of the subject agreement by failing to pay for the services.

As a result of the defendants' failure to honor its contract, they are indebted to U.S. FoodService in the amount of $4,680.28, according to the suit.

U.S. FoodService claims it has attempted to obtain payments from the defendants, but they have failed or refused to pay.

U.S. FoodService is seeking damages in the amount of $4,680.28 with pre- and post-judgment interest. The company is being represented by Steven R. Bratke and Lora B. Snodgrass.

The case has been assigned to Circuit Judge O.C. Spaulding.
