CHARLESTON -- A former employee is suing Terraco Inc. and Dickinson Fuel Company after he claims he was discharged from his employment because of his age.
Lonnie Elswick was employed by the defendants from Jan. 1, 1988 until Aug. 27, 2009, according to a complaint filed April 22 in Kanawha Circuit Court.
Elswick claims the defendants terminated his employment because of his age, which is in violation of the West Virginia Human Rights Act.
As a result of the defendants' discharge of Elswick's employment, Elswick claims he suffered income losses.
Elswick is seeking compensatory and punitive damages and either reinstatement to his former employment or front pay in lieu of reinstatement. He is being represented by J. Michael Ranson, Cynthia M. Ranson, George B. Morrone III and G. Patrick Jacobs.
The case has been assigned to Circuit Judge Charles King.
