Delbarton couple sues for defects in home

CHARLESTON -- A Delbarton couple is suing Freedom Homes and Vanderbilt Mortgage and Finance after they claim the companies have failed to repair defects in their home.

On Dev. 31, 2008, Ronald E. and Dolly Estepp purchased a 2008 Clayton Manufactured Home for $104,913, according to a complaint filed April 16 in Kanawha Circuit Court.

In January 2009, the Estepps claim the mobile home was set up with a footer, blocks and levels by Freedom Homes, but that within seven days of set-up and installation, the floors began to bow and cracks began to show in the top of the ceiling and in the crown molding, among other defects.

The Estepps claim they reported the problems, but that the defendants did not repair them.

Since the purchase of the home, the Estepps have suffered with aggravation, inconvenience and emotional distress due to the defects in their home, according to the suit.

The Estepps are seeking damages for costs to repair the defects. They are being represented by Jeffrey S. Simpkins.

The case has been assigned to Circuit Judge Louis Bloom.
