* On Dec. 28, 2009, Mr. Stanley slipped and fell on black ice and snow that had accumulated on the defendant's property. He claims the defendant's failure to use due care caused him to suffer severe, permanent and lasting injuries to his shoulders, back, neck and torso. The Stanleys are seeking compensatory damages.

* On March 12, Smith requested the defendants provide him with certain items under the West Virginia Freedom of Information Act. The defendants denied the FOIA requests. Newhouse said complying with the request would require 5.5 hours of research, would not be made available until Smith paid a $200 deposit and the cost to photocopy the records would be 25 cents per page after the first 10 pages, according to the suit. Smith is seeking the court declare the defendants' refusal unlawful and grant injunctive relief, enjoining the defendants from withholding records without justification and ordering production of the records improperly held to Smith.
