Former employee sues Arby's for failure to pay wages

WINFIELD -- A former Arby's employee after he claims he wasn't paid his wages in a timely manner after his employment was terminated.

Aubry Halsey was employed by Cartee Land Development, which is doing business as Arby's, from August 2009 until Feb. 11, 2010, when he was discharged from his job, according to a complaint filed April 26 in Putnam Circuit Court.

Halsey claims the defendant failed to pay his employment wages for the Jan. 25 to Feb. 7 pay period within 72 hours of his discharge. He claims the defendant did not pay him until Feb. 17.

The defendant's actions violated the West Virginia Wage Payment and Collection Act, according to the suit.

Halsey is seeking compensatory and punitive damages. He is being represented by Todd S. Bailess.

The case has been assigned to Circuit Judge O.C. Spaulding.
