Man sues Nova Rubber for violation of the Telephone Consumer Protection Act

CHARLESTON -- A Charleston man is suing Nova Rubber Company for violations of the Telephone Consumer Protection Act.

Jon Cormany received unsolicited junk fax transmissions from Nova Rubber Company on numerous occasions over an extended period of time, according to a complaint filed April 29 in Kanawha Circuit Court.

Cormany claims the faxes were sent without first obtaining his express consent and that he requested the defendant to cease the faxes, but that it continued to send them as part of its illegal marketing campaign.

Cormany is seeking for the defendant to be restrained from engaging in future telemarketing via facsimile. He is being represented by Brett J. Preston.

The case has been assigned to Circuit Judge Louis Bloom.
