Man sues MG&P Development, others for breach of contract

CHARLESTON -- A Branchland man is suing MG&P Development, Walgreen Co. and Asphalt's Contractor's & Site Work, Inc., after he claims they refused to pay him for services.

Johnny Midkiff was a subcontractor for Asphalt Contractor's & Site Work and agreed to perform certain construction work and provide materials, supplies and equipment to a construction project for the defendants, according to a complaint filed April 28 in Kanawha Circuit Court.

Midkiff claims after the work was completed, the defendants refused to pay him. He claims he made several attempts to collect the principal amount of at least $10,862.50.

The defendants breached their contracts with Midkiff by failing and refusing to pay for work performed and materials, supplies and equipment provided, according to the suit.

Midkiff is seeking damages in the amount of $10,862.50, plus pre- and post-judgment interest. He is being represented by Mark K. Prim.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
