Couple sues FedEx, employee for car accident

WINFIELD -- A Putnam County couple is suing FedEx Freight Systems and one of its employees after they were involved in a car accident.

On Sept. 12, 2008, Anthony and Elaine Musarra were pulling into the Go-Mart parking lot in Hurricane when Roger Pauley, who was employed by FedEx and driving a tractor trailer, was leaving the parking lot, according to a complaint filed May 5 in Putnam Circuit Court.

The Musarras claim when Pauley was leaving, the top of his vehicle hit telephone lines and electrical lines, pulling the lines and pokes onto the parking lot.

The lines wrapped around the right front tire of the Musarra vehicle, pushed it sideways and tipped approximately 30 inches from the pavement and then jerked back to the right upright position, according to the suit.

FedEx is liable for the careless, reckless and negligent conduct of their employee, according to the suit.

The Musarras claim they sustained injuries because of the accident.

The Musarras are seeking compensatory damages. They are being represented by Maggie K. Wall.

The case has been assigned to Circuit Judge Phillip Stowers.
