Fayetteville couple sues Citi for predatory lending practices

CHARLESTON -- A Fayetteville couple is suing CitiFinancial and CitiMortgage after they claim they engaged in the predatory lending practice of "flipping."

John R. Jones and Shelby J. Jones purchased their home in October 1989 for $10,000, and in April 2003, CitiFinancial obtained an inflated appraisal showing a market value of $79,000, but the actual market value was $53,800, according to a complaint filed May 4 in Kanawha Circuit Court.

In April 2009, the Joneses claim they made a claim on the credit insurance of their home and the defendants' response was that it had been canceled in 2006, but the Joneses had paid a claim in 2007.

The Joneses claim they have suffered economic loss, fear of loss of their home and annoyance and inconvenience.

The Joneses are seeking compensatory and punitive damages and civil penalties. They are being represented by Daniel F. Hedges and Bren J. Pomponio.

The case has been assigned to Circuit Judge Charles King.
