HUNTINGTON -- Frederick Management Company is suing a Huntington man for failure to pay rent for 72 months.
David Comer occupied and stored personal property under an agreement with the prior owner of property now owned by Frederick Management Company, according to a complaint filed May 3 in Cabell Circuit Court.
In May 2003, Frederick Management Company claims it notified Comer that his monthly rent would be $2,000, which was due on the first of each month.
On June 17, 2004, Comer was notified of his past due rent and was given one month's notice to vacate the premises, according to the suit.
Frederick Management Company claims Comer continued to wrongfully occupy the property until April 30, 2009, and is indebted to them for 72 months rent, totaling in the amount of $144,000.
The plaintiff is seeking judgment in the amount of $144,000, plus pre- and post-judgment interest and immediate possession of the property. It is being represented by John H. Hankins.
The case has been assigned to Circuit Judge David M. Pancake.
