WAYNE -- Alliance Wholesale Supply is suing Craig Morgan Trust, BB&T Collateral Service Corporation and an individual to enforce a mechanic's lien.
On April 8, 2009, Alliance began work pursuant to an agreement with Andrew Gallo, who was doing business as Gallo Construction, to furnish certain materials and labor, according to a complaint filed April 16 in Wayne Circuit Court.
Alliance claims it provided the roofing, interior doors, kitchen cabinets and granite countertops in the amount of $61,711.58, for a residential building which was then being constructed by Gallo as the principal contractor for Craig Morgan Trust.
Within 90 days from the date Alliance ceased to furnish the materials and labor, it caused to be recorded in the Office of the Clerk of the County Commission of Wayne County a notice of lien, stating that it claimed a lien upon the property to secure the payment of the sum of $61,711.58, according to the suit.
Alliance claims the defendants have not paid for the materials and labor.
Alliance is seeking that the property be sold to pay off and satisfy the claim for the sum of $61,711.58, after the liens on the property and their priorities have been duly ascertained. It is being represented by Glenn J. Robinette.
The case has been assigned to Circuit Judge James H. Young.
