Copley Construction sues couple for failure to pay more than $30,000 for services

WAYNE -- Copley Classic Construction is suing a Wayne County couple after it claims they have failed to pay more than $30,000 for construction services.

Delbert C. McCloud and Kathy S. McCloud own property in Wayne County and in July 2006, Copley Classic Construction entered into a contract with the McClouds for the construction of a log home, according to a complaint filed April 22 in Wayne Circuit Court.

Copley claims the McClouds agreed to pay $35,460 for the construction.

The plaintiff properly and fully completed all obligations under the contract in May 2007, but the McClouds failed and refused to honor their payment obligations under the contract and have breached the contract, according to the suit.

Copley claims the defendants owe $34,664.13, plus interest.

Copley is seeking damages in the amount of $34,644.13 plus pre- and post-judgment interest. It is being represented by Scott D. Maddox.

The case has been assigned to Circuit Judge James H. Young.
