Fort Gay father sues Wayne school board for daughter's injuries

WAYNE -- A Fort Gay father is suing the Wayne County Board of Education after his daughter was injured from falling down a flight of stairs.

On Oct. 30, 2009, Mackenzie Methax, who was a student at Ft. Gay Elementary School, was walking with her classmates and teacher to an art class located outside of the main school building when she fell down a flight of stairs and was injured, according to a complaint filed May 3 in Wayne Circuit Court.

Jimmy Methax, Mackenzie Methax's father, claims the Board of Education had a duty to safeguard its students to protect them from any harm and failed to do so.

As a result of the defendant's negligence, Mackenzie Methax sustained physical and mental pain and suffering; a diminution in her capacity to enjoy life; embarrassment; humiliation; annoyance and inconvenience; and has incurred expenses for medical care, according to the suit.

Jimmy Methax is seeking compensatory damages. He is being represented by Roger L. Lambert.

The case has been assigned to Circuit Judge James H. Young.
