Cabell couple sues Furniture Row Companies for defective waterbed

HUNTINGTON -- A Cabell County couple is suing Furniture Row Companies and Pillow Plus Manufacturing Corporation for a defective waterbed that allegedly lead to breathing problems.

John Does 1 through 10 as unknown component part and mattress manufactures were also names as defendants in the suit.

On Feb. 19, 2002, Donald Holley and Amber Holley purchased a Tango 1 California King waterbed from the defendant in Barboursville, according to a complaint filed June 1 in Cabell Circuit Court.

The Holleys claim twice during the first few years that they owned the bed, one of the water tubes at the foot of the bed began to leak and they had it replaced by the defendants.

In June 2008, Mr. Holley was making the bed when he noticed water underneath the bed and discovered mildew and black mold on the waterbed, according to the suit.

The Holleys claim they discovered the replacement water tube had started leaking and had seeped through the sponge onto the particle board underneath, which was part of the waterbed pedestal, and the board fell apart in many places.

During the water problems, the Holleys developed severe acute breathing problems and in 2008, Mrs. Holley was hospitalized approximately five times for the breathing problems, according to the suit.

The Holleys claim the defendants released defective products that did not conform to the applicable manufacturer's warranty.

The Holleys are seeking compensatory damages. They are being represented by Timothy P. Rosinsky and Michael Paesani.

The case has been assigned to Circuit Judge F. Jane Hustead.
