CHARLESTON -- A Poca couple named 48 defendants in an asbestos-related law suit involving lung cancer.
On Aug. 19, 2009, Shirley Guy Chancey was diagnosed with lung cancer, according to a complaint filed May 14 in Kanawha Circuit Court.
Chancey was employed by Union Carbide Corporation from 1959 until 1991 as an insulator, according to the suit.
Chancey and his wife, Louise Dale Chancey, claim he smoked on and off from 1952 until 2009, but has since quit.
The defendants are being sued for negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentation and post-sale duty to warn, according to the suit.
The Chanceys are seeking a jury trial to resolve all issues involved in the case. They are being represented by Victoria Antion and Lawrence J. Tweel.
The case has been assigned to a visiting judge.
