CHARLESTON -- A couple is suing General Motors Corporation, Dutch Miller Chevrolet and Branch Banking & Trust Company for defects in a 2008 Chevrolet Impala.
On Feb. 2, 2009, Joseph and Deborah Snavely entered into a motor vehicle purchase contract with the defendants, according to a complaint filed May 21 in Kanawha Circuit Court.
The Snavelys claim the defendants assured them the vehicle had no history of prior problems or damage, but in fact the vehicle had a history of defects, including extensive damage from submersion or water infiltration and/or prior repairs that the defendants had actual knowledge of.
The defendants breached the vehicle's express and/or implied warranties and failed to promptly refund money paid upon the rightful revocation or rejection of the vehicle and cancelation of the transaction, according to the suit.
The Snavelys are seeking the contract be declared canceled; that the court enter a declaratory judgment declaring the defendants to be in violation of the West Virginia Consumer Credit and Protection Act; compensatory and punitive damages; and pre- and post-judgment interest. They are being represented by David L. Grubb and Cameron S. McKinney.
The case has been assigned to Circuit Judge Charles King.
