Boone Co. couple sues GMC, others for defective vehicle

CHARLESTON -- A Boone County couple is suing GMC, C&O Motors and Fifth Third Bank for a defective vehicle.

On May 3, 2008, Van and Kimberly Jenkins entered into a motor vehicle purchase contract with the defendants for the purchase of a 2008 Chevrolet Malibu, according to a complaint filed May 24 in Kanawha Circuit Court.

The couple claims after they purchased the vehicle they discovered and experienced repeated nonconformities that impaired the use, value and/or safety of the vehicle.

The defendants failed and refused to provide a comparable replacement vehicle and to reimburse the Jenkinses for the defective vehicle, according to the suit.

The plaintiffs are seeking the contract be declared canceled and compensatory and punitive damages. They are being represented by David L. Grubb and Cameron S. McKinney.

The case has been assigned to Circuit Judge James C. Stucky.
