CHARLESTON -- A woman is suing K-V Pharmaceutical Company, Ethex Corporation and Target Pharmacy for her daughter's wrongful death.
William J. Anderson and "JAR," both pharmacists at Target Pharmacy, were also named as defendants in the suit.
Mia Alicia Chandler ingested a recalled Ethex pharmaceutical product, which was prescribed by her physician, between Jan. 8 and May 26, 2008, according to a complaint filed May 24 in Kanawha Circuit Court.
Cheryl Sue Belton, Chandler's mother, claims the defendants knew or should have known about the manufacturing and production defects, misbranding and negligent sale and distribution of the recalled pharmaceutical products.
Belton claims her daughter experienced side effects and reactions by an overdose of the pharmaceutical products, which resulted in her death.
The defendants failed to implement or utilize adequate testing, including batch testing, batch dose verification, and other procedures, safeguards and inspections or confirm, monitor and assess the quality, dose and safety of the Ethex recalled pharmaceutical products, according to the suit.
Belton is seeking compensatory and punitive damages. She is being represented by Joshua I. Barrett and Lonnie C. Simmons.
The case has been assigned to Circuit Judge Louis Bloom.
