Cedar Grove woman sues Video Village for injuries

CHARLESTON -- A Cedar Grove woman is suing Video Village after she fell and injured herself on its premises.

On June 16, 2008, Delores Rucker was a customer shopping at Video Village and was going out to her car when she was injured, according to a complaint filed May 28 in Kanawha Circuit Court.

Rucker "was going out to her car when she turned to the left, stepped out and fell forward because the surface was not where she expected it to be," according to the suit.

Rucker claims she fell to the ground and suffered injuries to her right elbow and underwent surgery on June 19, 2008.

As a direct result of the defendant's negligence, Rucker was forced to incur doctor, hospital and prescription medication expenses in excess of $25,000, according to the suit.

Rucker is seeking compensatory damages. She is being represented by Edward K. Rotenberry and Mark E. Wills.

The case has been assigned to Circuit Judge Carrie Webster.
