Danny Adkins vs. Robert Stowers

* Judge Hoke scheduled June 25 for removal of case from Magistrate Court. Adkins, of Myra, appealed Magistrate judgment giving possession of a tractor, plow and scraper blade to Stowers of Salt Rock. Stowers originally complained Adkins would not give him the equipment, which he says he bought from the estate of his late uncle.

Vanderbilt Mortgage & Finance, Inc. vs. Barry G. Stowers
PA- Marc B. Lazenby; J- Hoke
* Vanderbilt wants Court order requiring Stowers and everyone else occupying specified real estate at Sumerco to vacate. Complaint says a loan of more than $100,600, was provided to Stowers in December 2008 for the property, which served as security. Vanderbilt says Stowers failed to make any monthly payments since August 2009, which led to a foreclosure sale last May at the County Court House. Plaintiff's $72,000 was the highest bid and a May 26 deed conveyed the Ely Fork Road property to Vanderbilt.

* Court scheduled a hearing for Aug. 6 on companies' petition to obtain right to remove some three graves in Jefferson District and transfer and reinter those remains in a suitable cemetery. Robin Land Co. says it has surface title to the land where Anderson Cemetery No. 2 is situated and also is lessee for all related coal mining rights. Robin Land needs to move the buried remains and provide new graves and markers.

Branch Banking & Trust Co. vs. Elmer Workman
PA- Christopher R. Moore; J- Hoke
* BB&T seeks more than $20,600, from the former Kanawha County resident owed on a retail note and security agreement dated January 2007. There has been a change of venue from Kanawha Circuit Court to Lincoln County, where Workman now resides at Hamlin.
