Deputy sues Cabell County officials for not getting promoted

HUNTINGTON -- A Cabell County Sheriff's Deputy is suing the Cabell County Civil Service Commission and Cabell County Sheriff Tommy McComas for failure to promote him.

John Sears, George Kisor and Charles McComas were also named as defendants in the suit.

On Dec. 2, 2002, the defendants illegally passed Michael Adkins over for a promotion despite that he had the highest score on the promotion test and more time in service than other candidates who were promoted, according to a complaint filed June 4 in Cabell Circuit Court.

Adkins claims while he was eventually promoted to Corporal in February 2008, the losses in denied back pay and delay in rank advancement have been substantial and are ongoing.

He is being represented by Kit Thornton.

The case has been assigned to Circuit Judge F. Jane Hustead.
