Former employee sues Superior Carriers for wrongful termination

CHARLESTON -- A former employee is suing Superior Carriers after he claims his employment was wrongfully terminated.

On July 17, 2008, Ernest Hylton was injured while working for Superior Carriers and began receiving workers' compensation benefits for temporary total disability, according to a complaint filed June 25 in Kanawha Circuit Court.

On Feb. 2, 2009, Hylton received a letter from Superior Carriers that indicated that his employment had been terminated, according to the suit.

Hylton claims when he received the letter he was still on leave for temporary total disability and that the defendant's actions are "illegal, wrongful and done with actual malice toward plaintiff."

Hylton is seeking compensatory and punitive damages. He is being represented by Larry O. Ford.

The case has been assigned to Circuit Judge Charles King.
