CHARLESTON -- A Kanawha County couple is suing Parties Are Us and McJunkin Red Man Corporation after their five-year-old son was injured.
On June 10, 2008, Devon Nicholas Chamberlain was an invited guest at a family fun day activity sponsored by McJunkin Red Man Corporation and was being assisted and supervised by an employee of Parties Are Us when he was severely injured while using a hazardous and/or dangerous piece of the inflatable playground, according to a complaint filed June 8 in Kanawha Circuit Court.
Charles B. Chamberlain II and Daniela E. Santos claim the defendants owed a duty to them to act with reasonable care and to maintain the premises and equipment in a reasonably safe condition to ensure that the inflatable playground equipment was safe and functional.
The defendants breached their duty by allowing a hazardous and/or dangerous condition to exist, by failing to warn of the condition and failing to employ appropriate protective measures to ensure such conditions would not exist without proper warning, according to the suit.
The plaintiffs are seeking compensatory damages. They are being represented by Robert D. Cline Jr., Robert A. Campbell and Francis M. Curnutte III.
The case has been assigned to Circuit Judge James C. Stucky.
