* Couper Lanham, age 6, was a passenger on an ATV driven by his father David Lanham. When they attempted to climb a dangerously steep hill, the ATV overturned. Smith claims Couper was not wearing a helmet and sustained a skull fracture and a lacerated liver. Smith also alleges that David Lanham was intoxicated at the time of the accident. She is seeking compensatory and punitive damages, attorney fees, pre and post judgment interest.
