Former employee sues Allegheny Energy, others for wrongful termination

MORGANTOWN -- A Grafton man is suing Allegheny Energy Supply Company and Allegheny Energy Service Corporation for wrongful termination.

Charles Allen McDonald and Ben Stout were also named in the suit.

Timothy W. Smith was employed by the defendants from April 5, 1988, until March 3, 2009, according to a complaint filed June 9 in Monongalia Circuit Court.

Smith claims upon termination of his employment, he asked the defendants to reconsider his termination, but it was denied.

The reason for Smith's termination, he claims, was because he reported a safety issue and the defendants were retaliating against him for reporting the life threatening safety issues.

Smith claims the defendants also failed and refused to pay all wages due within 72 hours.

Smith is seeking damages for lost wages, lost benefits, mental and emotion distress and punitive damages. He is being represented by Walt Auvil.
