CHARLESTON -- A former employee is suing Environmental Management, Environmental Management Construction and his former supervisor after he claims he was discriminated against.
Joseph Beasley worked for EMI as a general laborer and on June 18, 2008, was directed by Roy Allen Conway to operate a sweeper truck with defective equipment, according to a complaint filed June 14 in Kanawha Circuit Court.
Beasley claims the sweeper truck had flat tires, worn sweeper brushes, inoperative signal lights and inoperative headlights.
When Beasley refused to operate the defective sweeper truck until the defective equipment was repaired, his employment was terminated, according to the suit.
Beasley claims the defendants did not pay his wages in full within 72 hours of his termination.
The defendants' conduct in terminating Beasley's employment constitutes a direct violation of the substantial public policy recognized under West Virginia law, according to the suit.
Beasley is seeking compensatory and punitive damages. He is being represented by Mark L. French.
The case has been assigned to Circuit Judge James C. Stucky
