Kanawha woman sues Dunbar First Church of God for injuries

CHARLESTON -- A Kanawha County woman is suing Dunbar First Church of God for injuries she sustained from a fall in the church's kitchen.

On Feb. 15, 2009, Virginia Nesselrotte was moving through the church kitchen when she took a step backward and fell over the industrial mixer, according to a complaint filed June 16 in Kanawha Circuit Court.

Nesselrotte claims the mixer was a known hazard because it was not placed in a safe place.

The defendant received numerous requests by Nesselrotte and others to move the industrial mixer to a safe resting place, but did not do so, according to the suit.

Nesselrotte claims she suffered injuries to her left shoulder, left arm, left wrist, a torn rotator cuff and torn ligaments and tendons.

Nesselrotte is seeking compensatory damages. She is being represented by William E. Murray.

The case has been assigned to Circuit Judge Louis Bloom.
