Man sues Wells Fargo for predatory lending practices

CHARLESTON -- A Charleston man is suing Wells Fargo after he claims the company engaged in predatory lending practices.

In March or April 2006, Robert Wayne Sullivan was solicited by Wells Fargo to refinance into one loan consolidating mortgages and bills into one adjustable mortgage with a three-year rate with the representation that he would be refinanced before the three-year reset kicked in, according to a complaint filed June 17 in Kanawha Circuit Court.

Sullivan claims prior to the reset he attempted to refinance with the defendants but was denied.

On July 30, 2009, Sullivan sent a certified letter to Wells Fargo directing all further communications to his attorney, but the company continued to attempt to communicate with Sullivan in an effort to collect debt, according to the suit.

Sullivan claims Wells Fargo proceeded with foreclosure on his home, despite his intent to continue to make payments.

Sullivan is seeking actual damages and civil penalties. He is being represented by Daniel F. Hedges.

The case has been assigned to Circuit Judge Carrie Webster.
