Woman sues MU Board of Governors for father's death

HUNTINGTON -- A Lincoln County woman is suing the Marshall University Board of Governors after she claims it is responsible for her father's death.

On Sept. 7, 2007, Eddie Lee Bud Lambert presented to the Emergency Department of St. Mary's Medical Center complaining of pain in the lower right abdomen, according to a complaint filed June 22 in Cabell Circuit Court.

A CT scan was performed, which revealed a large surrounding mass in the right renal fossa surrounding the pelvocaliceal system, according to the suit.

On Sept. 21, 2007, Dr. Frank Richter performed a right nephrectomy on Lambert.

On Oct. 3, 2008, Lambert's daughter, Vivan Combs, claims her father was admitted to St. Mary's Medical Center for abnormal laboratory results and intractable pain, where a CT scan was performed and revealed an extensive retroperitoneal tumor.

On Nov. 3, 2008, Lambert died, according to the suit.

Combs claims the defendant was negligent in caring for her father and failed to exercise a degree of care, skill and learning required or expected of reasonable, prudent health care providers.

Combs is seeking compensatory damages. She is being represented by Larry O. Ford.

The case has been assigned to Circuit Judge F. Jane Hustead.
