Wayne Co. man sues former employer for failure to pay wages

HUNTINGTON -- A Wayne County woman and former employee is suing Brian P. Conaty for failure to pay more than $26,000 in wages.

Desiree Lynnette Garnes was employed by Conaty from June 20, 2008, until Dec. 3, 2008, according to a complaint filed June 18 in Cabell Circuit Court.

Garnes claims the defendant agreed to pay her $30 per hour for each hour she billed against his clients' accounts as compensation.

Upon leaving employment at Conaty's, he owed Garnes about $26,801, according to the suit.

Garnes claims Conaty is liable to her for the amount of her regular pay and liquidated damages of three times the amount.

Garnes claims on numerous occasions she requested payment of the wages, but Conaty has failed and refused to pay.

Garnes is seeking judgment in the amount of $80,403. She is representing herself.

The case has been assigned to Circuit Judge David M. Pancake.
