Man sues Division of Veteran's Affairs for fall down stairs

HUNTINGTON -- A man is suing the West Virginia Division of Veteran's Affairs after she was injured from falling down the stairs.

The West Virginia Veterans' Home and John Does 1 through 10 were also named as defendants in the suit.

On Dec. 26, 2008, Steven M. Lego, who was a resident of the West Virginia Veterans' Home, fell down the stairs and sustained multiple injuries, according to a complaint filed June 22 in Cabell Circuit Court.

Lego claims the defendants failed to properly design, engineer, construct, inspect, operate, clean, maintain or warn of the hazards of using and residing at the West Virginia Veterans' Home.

As a result of the defendants' failure, Lego sustained a fracture of the radial head of his left elbow that required surgery, according to the suit.

Lego is seeking compensatory damages. He is being represented by J. Patrick L. Stephens and Mark F. Underwood.

The case has been assigned to Circuit Judge F. Jane Hustead.
