CHARLESTON -- A Nitro man and former employee is suing WV Dream Homes after he was injured on the job.
On Oct. 15, 2008, Michael Wingett was kneeling down while other co-workers were manually pulling the tress of a garage into place when he fell approximately 12 feet and landed on a cinder block wall, according to a complaint filed June 17 in Kanawha Circuit Court.
Wingett claims the defendant did not provide any type of fall protection while building the homes.
As a result of the fall, Wingett's femur broke and tore through the back of his leg, protruding through his leg muscles, according to the suit.
Wingett claims he also suffered a concussion and numerous severe and permanent injuries, including back injuries.
The defendant had actual knowledge of the existence of the unsafe working condition that led to Wingett's fall and violated state and/or federal safety rules, according to the suit.
Wingett is seeking compensatory damages. He is being represented by J. Timothy DiPiero.
The case has been assigned to Circuit Judge Carrie Webster.
